California lawmakers have proposed changes, including SB 58, but that bill was vetoed and did not create lawful statewide personal use or commercial retreat activity.

The language of the Oakland measure also helps explain how far it goes. The city focused on adults and on lowest enforcement priority. That wording leaves room for enforcement activity in other settings, especially when conduct looks commercial, public, or tied to a storefront or organized sales operation. The supporting agenda report also said the campaign view was that entheogens should not be commodified, and it stated there would be no sales of entheogenic plants and fungi.

Why commercial retreat operations remain exposed

If someone markets a paid psilocybin retreat in Oakland, you should read that offer against California law, not just against the Oakland resolution. California still treats psilocybin and psilocyn as controlled substances, and recent bills that could have changed personal possession rules did not become law. That means a commercial trip model built around paid access to psilocybin still lacks a lawful statewide basis.

That legal gap carries practical consequences. A retreat package can involve sourcing, transport, possession, facilitation, venue use, screening, and payment. Oakland’s local resolution does not authorize those business steps. It only changes city enforcement posture for adult entheogenic plant activity by making it a low priority. If an operation shifts into storefront sales, packaged commercial services, or other organized distribution conduct, the risk goes up fast because you are outside any licensed state framework.

Oakland still takes action against illegal sales activity

Recent enforcement in Oakland shows why “decriminalized” is too broad a label. In August 2025, Oakland Police said officers investigated an unlicensed smoke shop, seized illegal substances including psilocybin mushrooms, and forwarded the case to the Alameda County District Attorney for criminal charges. The city also said the City Attorney’s Office would pursue legal action against the tenants. That is a direct sign that Oakland still acts against illegal commercial activity tied to controlled substances, including psilocybin mushrooms.

Is this just a city policy that lowered enforcement priority for adult entheogenic plant use, or is this a commercial activity that still sits inside California’s criminal framework.
